These Terms and Conditions govern your use of the Niksin CCTV website and enquiries relating to our CCTV products, security equipment and related services.

Welcome to the Niksin CCTV website. These Terms and Conditions govern your access to and use of this website, including any enquiries you submit regarding our CCTV products, surveillance equipment, security accessories, installation services and related solutions.

By accessing or using this website, you acknowledge that you have read and agreed to these Terms and Conditions. Please discontinue using the website if you do not agree with them.

1. About Niksin CCTV

Niksin CCTV, also referred to in these Terms as “NIKSIN”, “we”, “us” or “our”, supplies CCTV products, surveillance equipment, security accessories and related solutions.

2. Website Purpose

This website provides general information about our products and services and allows customers to contact us for enquiries.

The website does not currently process purchases or payments directly. Submitting an enquiry form, sending us an email, clicking a WhatsApp button or requesting product information does not automatically create a confirmed order or binding contract.

An order is only confirmed after:

  1. We confirm the product, quantity, price and availability.
  2. Any applicable delivery or installation charges are agreed upon.
  3. We issue a quotation, invoice or written order confirmation where applicable.
  4. The required payment or deposit has been received.

3. Product Information

We make reasonable efforts to ensure that product descriptions, specifications, photographs and other information displayed on the website are accurate.

However:

  • Product colours and appearance may vary depending on lighting, photography and screen settings.
  • Product packaging, specifications, features and accessories may be changed by the manufacturer without prior notice.
  • Images may include optional accessories or installation examples that are not included with the standard product.
  • Product compatibility depends on the customer’s existing equipment, network, cabling, property layout and intended use.

Customers should confirm all important specifications, compatibility requirements and included accessories with us before making payment.

4. Product Availability

All products displayed on the website are subject to availability.

Displaying a product on the website does not guarantee that it is currently in stock. If a selected product is unavailable, we may recommend an alternative model with similar features and pricing.

We will not substitute a product without informing the customer and obtaining agreement where the substitute materially differs from the original selection.

5. Prices and Quotations

Unless otherwise stated, prices displayed on the website are provided for general reference only and may change without prior notice.

The final price may depend on factors including:

  • Product model and quantity;
  • Current supplier pricing;
  • Installation location;
  • Cable type and cable length;
  • Number of cameras or devices;
  • Mounting requirements;
  • Network configuration;
  • Power supply requirements;
  • Additional equipment or accessories;
  • Site accessibility;
  • Delivery charges; and
  • Any additional work requested by the customer.

A quotation is valid only for the period stated in the quotation. Where no validity period is stated, the quotation will normally remain valid for fourteen days, subject to product availability and supplier price changes.

6. Orders and Payments

Payment instructions, deposits and payment schedules will be provided through our quotation, invoice or written confirmation.

Customers are responsible for checking the product model, quantity, installation address, delivery details and quotation information before making payment.

An order may not be processed until the required deposit or full payment has been received and verified.

We may suspend or cancel an order if:

  • Payment cannot be verified;
  • The product is unavailable;
  • Incorrect pricing or product information was provided;
  • We reasonably suspect fraud or unauthorised activity; or
  • The customer does not provide information required to complete the order.

Any refund arising from such cancellation will be handled according to the circumstances, the agreed quotation and applicable Malaysian law.

7. Delivery and Collection

Delivery dates and times are estimates unless expressly confirmed in writing.

Delivery may be affected by product availability, supplier delays, courier delays, traffic conditions, weather, public holidays or other circumstances outside our reasonable control.

Customers must provide an accurate delivery address and ensure that someone is available to receive the products.

The customer should inspect delivered products promptly and inform us as soon as reasonably possible if any item is missing, incorrect or visibly damaged.

Risk relating to the products may pass to the customer upon delivery, collection or installation, depending on the agreed sales arrangement.

8. Installation Services

Installation is provided only when it is included in the accepted quotation or separately agreed in writing.

Before installation, the customer must:

  • Provide safe and reasonable access to the property.
  • Obtain permission from the property owner, building management or relevant authority where required.
  • Inform us about concealed electrical wiring, water pipes, gas pipes, network cables or other property risks.
  • Ensure that suitable electricity and internet connectivity are available where required.
  • Remove or protect valuable, fragile or obstructing items near the work area.

Installation charges may change if previously undisclosed site conditions require additional equipment, cabling, labour, drilling, repair work or specialised access.

We will inform the customer before performing material additional work that is not included in the accepted quotation.

Minor drilling marks, cable routes and reasonable installation effects may be unavoidable. Unless expressly included in the quotation, our installation service does not include repainting, plastering, ceiling repair, renovation or decorative restoration.

9. CCTV Placement and Lawful Use

Customers are responsible for using CCTV and security equipment lawfully and responsibly.

The customer must ensure that cameras, microphones and recording functions are not used unlawfully or in a manner that unreasonably interferes with another person’s privacy.

Depending on the property and intended use, the customer may need to:

  • Display appropriate CCTV notices;
  • Obtain permission from a landlord, building management or property owner;
  • Inform employees, tenants, visitors or other affected individuals;
  • Avoid recording private areas or neighbouring properties;
  • Control access to recorded footage; and
  • Follow applicable privacy, employment, building management and data protection requirements.

NIKSIN does not provide legal advice regarding the placement or operation of surveillance equipment. Customers should obtain professional advice when they are unsure about their legal responsibilities.

10. Remote Viewing and Internet Services

Certain CCTV products require internet access, mobile applications, cloud services or third-party accounts for remote viewing and notifications.

The performance of these functions may depend on:

  • The customer’s internet connection;
  • Router and network configuration;
  • Mobile device compatibility;
  • Third-party applications or cloud platforms;
  • Manufacturer servers;
  • Subscription services; and
  • Changes made by telecommunications or software providers.

We do not control third-party platforms and cannot guarantee that remote access, mobile applications or cloud services will always be uninterrupted or available.

Customers are responsible for maintaining secure passwords and preventing unauthorised access to their devices, applications and CCTV accounts.

11. Warranty

Product warranties vary according to the manufacturer, brand, model and supplier.

The applicable warranty period and coverage will be stated in the quotation, invoice, warranty card or manufacturer’s documentation where available.

Warranty coverage generally does not include damage caused by:

  • Accidents, misuse or negligence;
  • Unauthorised repairs or modifications;
  • Improper handling;
  • Power surges, lightning or unstable electricity;
  • Water, fire, pests or environmental damage;
  • Internet or network problems;
  • Physical damage;
  • Failure to follow product instructions;
  • Normal wear and tear; or
  • Use of incompatible equipment or accessories.

Customers may be required to provide the invoice, warranty card, serial number, photographs or other information when submitting a warranty claim.

Repair or replacement decisions may be subject to inspection and approval by the manufacturer, distributor or supplier.

Nothing in these Terms excludes any warranty, guarantee or consumer right that cannot lawfully be excluded under Malaysian law.

12. Returns, Exchanges and Cancellations

Customers should contact us before returning any product.

Eligibility for cancellation, return, exchange or refund will depend on:

  • The condition of the product;
  • Whether the packaging has been opened;
  • Whether the product has been installed, configured or activated;
  • Whether the product was specially ordered;
  • The manufacturer’s or supplier’s return requirements;
  • The terms stated in the accepted quotation or invoice; and
  • Applicable Malaysian consumer protection law.

Products that have been installed, configured, registered, customised, specially ordered or damaged after delivery may not be eligible for a change-of-mind return, except where required by law.

Cancellation of an installation appointment may result in reasonable charges where products have already been ordered, technicians have been scheduled or work has commenced.

Defective or incorrectly supplied products will be handled according to the applicable warranty, agreed sales terms and legal consumer protections.

13. Customer Responsibilities

Customers must provide complete and accurate information when making an enquiry or placing an order.

Customers must not:

  • Submit false contact or payment information;
  • Impersonate another person;
  • Use the website for unlawful purposes;
  • Attempt to gain unauthorised access to the website or its systems;
  • Introduce viruses, malicious software or harmful code;
  • Copy website content for unauthorised commercial use; or

CCTV and security products are intended to assist with monitoring, recording and deterrence. They cannot guarantee that theft, trespass, damage, accidents or other incidents will not occur.

Nothing in these Terms excludes or limits liability that cannot legally be excluded, including applicable statutory consumer rights.

19. Indemnity

To the extent permitted by law, you agree to be responsible for claims, losses or expenses arising from your unlawful use of the website, your unlawful operation of CCTV equipment or your violation of another person’s rights.

This clause does not apply where the claim or loss was caused by NIKSIN’s negligence, breach of contract or failure to comply with applicable law.

20. Changes to These Terms

We may update these Terms and Conditions when our products, services, website operations or legal obligations change.

The revised Terms will be published on the website with an updated revision date. Continued use of the website after the revised Terms are published constitutes acceptance of the updated Terms.

Confirmed orders will generally remain subject to the terms agreed at the time of confirmation unless both parties agree otherwise or a change is required by law.

21. Governing Law

These Terms and Conditions are governed by the laws of Malaysia.

Any dispute should first be raised directly with NIKSIN so that both parties may attempt to resolve the matter reasonably.

Nothing in this clause prevents a consumer from exercising rights or seeking remedies available under applicable Malaysian consumer protection laws.
